The company has triggered the dispute resolution proceedings for work undertaken in November and December claiming EGMS failed to pay it properly, flagging a discrepancy in ounces recorded and errors in calculation of belt calibration adjustments.

Empire managing director David Sargeant told MNN there had been "a lot of discussions" with Maximus in recent weeks.

Mining started at the deposit in mid-2017 but first gold production in the December quarter because there were issues at the Burbank mill almost immediately.

Empire says the July 2017 tolling agreement was signed in the belief the mill was ready to start, but that it was not commissioned for three months while EGMS brought the mill up to code and worked out several issues.
